Terms of auction

  1. All lots are auctioned in the name and for the account of third parties.

  2. The auction is public and voluntary and is conducted against cash payment in Swiss francs. Foreign currencies are accepted at the daily exchange rate or according to the credit note from a Swiss bank. Lots are generally handed over only after full payment of the auction invoice. It is at the sole discretion of the auctioneer to release lots on account. Lots handed over to the buyer remain the property of the auctioneer until full payment has been received. If purchased lots are to be sent by post or by other means, this is done at the buyer’s risk. Shipping and insurance costs will be charged separately. Unless otherwise agreed before the auction, the invoice must be paid no later than 20 days after the invoice date.

  3. The auctioneer reserves the right to deviate from the order of the lots, to combine lots, or to withdraw them.

  4. The bidding increments are as follows:
    • up to CHF 100: CHF 5
    • up to CHF 300: CHF 10
    • up to CHF 600: CHF 20
    • up to CHF 1,500: CHF 50
    • up to CHF 3,000: CHF 100
    • up to CHF 10,000: CHF 200
    • above CHF 10,000: CHF 500

      Any bids placed between these increments will be rounded up accordingly.

  5. The lot is awarded to the highest bidder. In the case of equal bids, written bids take precedence, with the order of receipt being decisive. In the event of doubt or disputes, the lot will be reoffered at the discretion of the auctioneer. The hammer price will not necessarily be the highest written bid, but rather the lowest amount possible. For example, if you bid CHF 500 on a lot, and the next highest bid is CHF 400, you will win the lot for CHF 420 (one increment above the second-highest bid).

  6. A buyer’s premium (commission) of 22% will be added to the hammer price, as well as the statutory VAT of 8.1% on the total amount. For exports, VAT is waived upon presentation of export proof.

  7. The successful bid obligates the buyer to accept the lot: floor bidders must pay cash immediately, written bidders within 20 days of receiving the invoice or pre-invoice. For credit card payments, a fee of 3.5% of the invoice amount will be charged. Bank transfers must be made free of charge to our account.

  8. Complaints of any kind must be made immediately after the handover of the lots if the buyer or their representative is present. For written bidders, complaints must be made no later than five days after receipt of the lots. For illustrated lots, the image is decisive regarding margins, perforation, and postmark.

  9. All stamps offered are carefully described. For individual lots sold unexamined, we guarantee authenticity for one year. For certified stamps, the buyer accepts the certificates and signatures stated in the lot descriptions as binding, particularly concerning authenticity and quality. The buyer also acknowledges the completeness of the certificates. Any further liability of the auctioneer is excluded. The right to complain is void if stamps have been altered, except for expert markings by recognized experts who are liable for their mistakes. In cases of alleged forgeries or repairs of individual items without certificates, the buyer must provide proof and include a certificate from a recognized expert. Upon confirmation, the hammer price, including premium, VAT, and certificate fees, will be refunded. Any further claims are excluded. For lots containing two or more stamps (collections, accumulations, etc.), complaints are excluded. These are sold “as is.” Catalogue values indicated by the consignor are not binding for the auctioneer.

  10. In case of late payment, a fee of CHF 20 per reminder and interest of 1% per month commenced will be charged. The auctioneer reserves the right to either pursue the purchase price through legal action or to cancel the purchase and dispose of the lots otherwise, charging any possible price difference to the buyer. In this case, there is no obligation to deliver, but the buyer remains obligated to accept the lot.

  11. The auctioneer may, without providing reasons, exclude individuals from the auction. Trade and exchange of items are prohibited within the auction premises.

  12. The place of performance and exclusive place of jurisdiction for all parties is Horw, Switzerland. However, the auction company reserves the right to take legal action against a debtor at their place of residence. The auction is otherwise subject to the auction regulations of the municipality of Horw.

  13. By submitting bids or purchase orders, the bidder fully accepts the above auction terms and conditions. These terms also apply analogously to all transactions involving auction material concluded outside the actual auction.

  14. We disclaim all liability for any disruptions to internet service during the auction.
